Property Use and Guest Conduct

By booking a stay at Flyer's Nest, you agree to:

  • Treat the property with care and respect
  • Follow all house rules provided at check-in
  • Not exceed the maximum occupancy listed for the property
  • Not host parties or events without prior written approval
  • Report any damages or issues promptly
  • Leave the property in a reasonably clean condition

We reserve the right to terminate your stay immediately if these terms are violated, without refund.

Booking and Cancellation

Bookings made through third-party platforms (such as Airbnb or VRBO) are subject to the cancellation policies of those platforms. For direct bookings, please refer to our specific cancellation policy provided at the time of booking.

We reserve the right to cancel a reservation if we believe, in our sole discretion, that the guest intends to violate our house rules or these Terms.

Restrictions

You agree not to use our Services for any unlawful purpose or in any way that could damage, disable, or impair our website or interfere with other users' enjoyment of the Services.

To the fullest extent permitted by law, Flyer's Nest, its owners, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, lost enjoyment, or any other damages or losses arising out of or related to your use of the property or Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

In no event shall our total cumulative liability to you for any claims arising out of or related to this Agreement or your use of the Services exceed the amount you paid for your reservation.

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, so some of these exclusions may not apply to you. In such cases, our liability is limited to the maximum extent permitted by applicable law.

Assumption of Risk

You acknowledge that use of the vacation rental property involves inherent risks, including but not limited to risks associated with outdoor activities, swimming pools (if applicable), stairs, and other property features. You voluntarily assume all such risks and agree to exercise caution and good judgment during your stay.

Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Indemnification

You agree to indemnify, defend, and hold harmless Flyer's Nest, its owners, affiliates, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:

  1. Your use of the property or Services
  2. Your violation of these Terms
  3. Your violation of any third-party rights
  4. Any damage to the property caused by you or your guests
  5. Any claim that your actions during your stay caused damage to a third party

This obligation will survive the termination of this Agreement and your use of the Services.

Dispute Resolution and Governing Law

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is caused by events beyond our reasonable control, including but not limited to natural disasters (hurricanes, flooding, etc.), war, acts of terrorism, governmental actions, power outages, or any other force majeure event.

In the event of a force majeure event affecting your reservation, we will work with you to reschedule your stay or provide appropriate remedies as circumstances permit.

Changes to Terms

We reserve the right to update or modify these Terms at any time at our sole discretion. If we make material changes, we will provide notice by posting the updated Terms on our website. It is your responsibility to review the Terms regularly. Your continued use of the Services following any changes constitutes your acceptance of the updated Terms.
